Terms of Use

Platform purpose

MSW is a community platform for musicians, ensembles, venues, services and the broader music industry to discover one another, publish opportunities, and exchange instruments and equipment.

User responsibilities

• Provide truthful, up-to-date information.
• Keep your account credentials secure.
• Respect other users and applicable law.
• Only publish content you have the right to publish.

Acceptable content

Profiles, listings, events and jobs must be relevant to the music industry and lawful in Lithuania and the EU.

Prohibited content

• Illegal goods or services.
• Hate speech, harassment, threats or discrimination.
• Impersonation of another person or organization.
• Spam, scams or deceptive listings.
• Sexually explicit content.
• Content infringing third-party rights.

Your content stays yours

You keep ownership and any other rights you already hold in the content you submit to MSW, including descriptions, biographies, photographs, logos, media and listing, event or job materials. Submitting content to MSW does not transfer ownership to us.

Licence you grant to MSW

By submitting content to MSW, you grant MB „Future Clay“ a non-exclusive, worldwide, royalty-free licence, for as long as is reasonably necessary to provide the service, to host, store, back up, reproduce, technically process, format, resize, index, display and distribute that content through MSW.

This licence is limited to what is necessary to:

• provide and operate MSW;
• display your profile, listing, event or job as you requested;
• enable search, discovery and Atlas functionality;
• maintain technical backups and service integrity;
• carry out moderation, security and audit functions;
• comply with legal obligations.

Limits of the licence

The licence is not perpetual, not irrevocable, not transferable as a general right, and does not allow us to sell your content, license it commercially to third parties, or use it for purposes unrelated to operating MSW.

We may share your content only with service providers that we use to run MSW (for example hosting, storage, email delivery and content-delivery providers) and only so that they can provide those services to us.

We do not use your content to train general-purpose AI or machine-learning models. If we ever consider such use, it would require a separate, clearly communicated policy and your consent where required by law.

Public content

When you choose to publish content publicly, you allow us to make it available through the public parts of MSW that provide the service you requested — for example public profiles, search, maps and discovery surfaces, the public records interface, and link/share previews. We do not grant broader syndication rights to third parties.

Your rights to the content you submit

You confirm that you have the necessary rights or permissions to submit the content you upload — for example photographs, logos, descriptions, organisation materials and event, job or listing materials — and that submitting it does not breach anyone else's copyright, trademark, privacy or publicity rights.

This does not mean you must own the facts you provide: you may submit factual information that you are lawfully permitted to share.

Third-party rights and complaints

If you believe content on MSW infringes your rights, contact us at copyright@musicservices.world with the relevant details. We may hide, restrict, remove or investigate content where necessary for legal compliance, safety, enforcement of these Terms, or in response to a rights complaint.

Copyright complaints

If you are a rights holder, or authorised to act for one, and you believe that material on MSW uses your copyrighted work or other protected material without authorisation, you can report it to us at copyright@musicservices.world. You can also use the "Report" option shown on the content itself.

So that we can look into a report, please include:

• identification of the copyrighted work or other protected material concerned;
• the exact MSW address (URL) or location of the content you are complaining about;
• your name and contact details;
• an explanation of the rights you hold, or the authority you rely on to act for the rights holder;
• a statement that you believe in good faith that the use complained of is not authorised by the rights holder, its agent or the law;
• any further information that helps us understand and investigate the report.

How we handle copyright complaints

We review reports we receive and may contact you or the person who submitted the content for more information. Where appropriate, we may restrict, hide or remove content, or take other action under these Terms. We record the report and our decision for audit purposes.

Submitting a report does not automatically result in removal: each report is assessed on the information provided. Please do not send sensitive personal information that is not needed to assess the complaint. This section describes our own internal process; it is not a statement of any statutory notice procedure.

Facts, sources and provenance

MSW records factual information about people, organisations, events and activity in the music sector, together with references to the sources of that information. We do not claim ownership of facts, organisation or venue names, external websites, publications or other third-party material, and we do not republish complete external articles, documents or images.

Information recorded from public or governed sources is handled under our provenance and data practices and applicable law — it is not treated as content licensed to us by the subject of a profile. Content submitted by a user is governed by the licence above.

Links to your external accounts

Website and social links you add are references you provide. Adding a link does not give MSW access to that account, does not transfer any rights in it to MSW, and does not imply endorsement by, or a partnership with, the platform concerned.

MSW's own materials, rights holder and operator

MSW's own materials — the software, interface, original design, original documentation, product materials and the "Music Services World" and "MSW" names and logo as used for this service — were created by Nerijus Jasinskas. To the extent that rights in those materials arise and belong to him under applicable law, Nerijus Jasinskas is the rights holder; where any element is not protected, or is owned or licensed by someone else, this section does not claim rights in it.

Music Services World is currently operated by MB „Future Clay“, which uses these materials under a licence from Nerijus Jasinskas. "Music Services World" and "MSW" are the names of a service operated by MB „Future Clay“; no claim of trademark registration is made here.

This does not cover user content, third-party materials, open-source components, factual or public information, or anything else owned by its respective rights holder.

Permitted and prohibited use of MSW's own materials

You may use MSW normally as a visitor or member, and you may view, link to and share pages in the ordinary way. Unless we agree otherwise in writing, or the law allows it regardless of these Terms, please do not:

• reproduce, copy or republish MSW's own proprietary materials (software, interface, original design, original graphics, original written materials) beyond normal use of the service;
• redistribute or resell those proprietary materials, or use them to build or operate a competing copy of the service;
• systematically scrape, crawl or automatically harvest proprietary MSW materials, or place automated load on MSW that harms the service;
• reverse engineer, decompile or disassemble the MSW software, except where such activities cannot lawfully be restricted (for example permitted interoperability, error correction, security research or study of the underlying ideas);
• use the MSW names, logo or branding in a way that falsely suggests affiliation, endorsement, sponsorship, partnership, or that impersonates MSW or its operator.

What these restrictions do not cover

These restrictions apply only to MSW's own proprietary materials. They do not create ownership of, or restrict, facts and public information, user content, third-party material, or open-source components, which remain governed by their own rights and licences. Reasonable use of public factual metadata, and any use that applicable law permits regardless of contract, is not restricted by this section.

Deleting content and ending the licence

When you delete content or your account, the licence for ordinary display and service use ends within a reasonable technical period, and the content stops being shown publicly on MSW.

Copies may remain for a limited time in routine backups, and we may retain content or minimal records where reasonably necessary for security, prevention of fraud or abuse, legal obligations or dispute resolution.

MSW also keeps a minimal governance history of actions taken on records (for example that a record was created, edited, published or removed, when, and by which role). That history is about the actions, not a way to keep publishing deleted content: we do not retain full deleted text or images merely because a governance record exists.

Profile and listing moderation

Submitted content may be reviewed before becoming public. MSW administrators may approve, hide, edit or remove content that violates these Terms.

Marketplace disclaimer

MSW is not a party to any transaction between users. We do not verify the condition, ownership or legality of items listed. Buyers and sellers transact at their own risk.

Lost & stolen disclaimer

Lost and stolen reports are user-submitted and are not verified by MSW. Always contact the relevant authorities first.

No guarantee of transactions

MSW does not guarantee that any contact, listing, job or event will result in a successful transaction or engagement.

Administrator rights

MSW administrators may remove harmful, fraudulent or illegal content and suspend accounts that breach these Terms.

Limitation of liability

To the extent permitted by law, MSW and its operator are not liable for indirect or consequential damages arising from use of the platform or from interactions between users.

Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated through the platform.
